Shop4Charity Valentine’s Sweepstakes
(the “Official Rules”)
1. Sponsor and Entry Period
The Sweepstakes is offered by Shop4Charity Inc. (the “Sponsor”) and runs from 12:00:01 a.m. Pacific Time (“PT”) on January 1, 2016 to February 9, 2016 at 11:59:59 p.m. PT (the “Entry Period”).
To participate, enter or win in the Sweepstakes, you must be: (a) a legal resident of Canada (excluding residents of the Province of Quebec); and (b) over the age of majority in your province or territory of residence; and (c) located within Canada (excluding the Province of Quebec) at the time of entry.
Persons in any of the following categories are NOT eligible to participate, enter or win the Sweepstakes: any person who, at any time on or after December 1, 2015 , was or is a director, officer, employee, or agent of Sponsor, Deloitte LLP, any of their respective parent companies, subsidiaries, affiliates, franchisees, or service agencies, any entity engaged in the development, production or distribution of materials for the Sweepstakes, or any other entity engaged in the administration or execution of this Sweepstakes (collectively the “Sweepstakes Entities”), or the members of any immediate families (defined as parents, siblings, children, and spouses, regardless of where they live) or households (whether or not related) of any of the foregoing such persons. The Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Sweepstakes. Failure to provide such proof may result in disqualification.
By participating in the Sweepstakes, each person unconditionally accepts and agrees to comply with and abide by these Official Rules and by the decisions of the Sponsor in respect to the Sweepstakes and the meaning and application of these Official Rules, which decisions shall be final and binding with respect to all aspects of the Sweepstakes.
3. How To Enter
No purchase or payment is necessary to enter or win. A purchase will not increase your chances of winning. There are two ways to enter:
A. Receive a Bouquet: Purchase a bouquet of flowers from Sponsor (the “Bouquet”) during the Entry Period and, for each Bouquet, the recipient of the Bouquet (the “Participant”) will automatically receive one (1) entry (each, and “Entry” and collectively “Entries”) into the Sweepstakes. Purchaser must provide the Recipient’s full name, complete address, and telephone number (including area code). Only the Participant will be eligible to win, but both the purchaser of the Bouquet and the Participant must meet the eligibility criteria above. If you are a Participant who received a Bouquet and do not wish to be entered into the Sweepstakes, you may email us at email@example.com or call 1-888-295-0613 to opt out and will not receive an entry. To order a Bouquet, go online to valentinessweepstakesforthecure.ca or theshop4charity.ca (each and collectively, the “Official Website”) or by phone, call 1-800-901-4966, or by mail, to Shop4Charity 2016 Valentines Sweepstakes, P.O. Box 10, Brockville, ON, Canada K6V 5T8. The Bouquet will be delivered on either February 10, 11 or 12 2016, based on the Purchaser’s choosing. A unique 8- digit code evidencing entry into the Sweepstakes (each a “Sweepstakes Draw Code”) will be mailed to the Participant between February 12, 2016 to February 29, 2016.
B. To Enter the Sweepstakes without Purchase: To enter without purchase, hand write 50-75 words about why you love Valentine’s Day (the “Essay”) on a plain piece of paper, along with your full name, complete mailing address, telephone number (including area code), and a valid email address, and mail it to: Shop4Charity 2016 Valentine’s Sweepstakes, P. O. Box 10, Brockville, ON, Canada K6V 5T8, Attn: Valentine’s Sweepstakes Entry Request. Your request and Essay must be legibly hand written in ink on an 8.5” x 11” piece of paper. Each Essay must be original and written specifically for entry into this Sweepstakes. Duplicate or mass produced Essays or Entry request will be void. You must also include your return address on the exterior of the envelope, which must be legibly hand-printed in ink. Envelopes with no return address on the outside, or insufficient postage, will NOT be honoured. Requests that utilize address labels or stickers that are photocopied, hand-stamped, computer-generated, or otherwise mechanically produced or reproduced or that are not written manually in ink, fail to comply and as such will NOT be honoured. Upon receipt of a valid Entry request, you will qualify as a Participant and will automatically receive one (1) Entry into the Sweepstakes. Sweepstakes Draw Code will be emailed to Participant within twenty (20) business days from receipt of request. Please check your email and spam filters. LIMIT: One (1) Entry request per outer stamped envelope, and maximum of three (3) entry requests per day. Requests must be post marked during the Entry Period; if postmark is not visible Entry will not be accepted.
General: Each Participant will receive one (1) unique Sweepstakes Draw Code as evidence of each Entry. Sweepstakes Draw Codes shall be subject to verification and shall be null and void if they are found to not have been obtained in accordance with these Official Rules. Sponsor is not responsible for late or undelivered Sweepstakes Draw Codes. No mechanical reproductions of Sweepstakes Draw Codes permitted. If Sweepstakes Draw Code is not received by March 1, 2016 please contact the Sponsor. You may be required to surrender your Sweepstakes Draw Codes to claim a prize.
4. Selecting Winners
On or about March 4, 2016 (the “Draw Date”), a random draw will be conducted from among all eligible Entries received. Before any potential winner can be declared a winner of a Prize, he/she must first (i) correctly answer a time-limited mathematical skill testing question (the “Skill-Testing Question”) without assistance of any kind whether mechanical, electronic or otherwise, and (ii) read, execute and return a declaration of eligibility/release of liability (the “Prize Claim Document”) to the redemption center (the “Redemption Centre”) by the date indicated on the Prize Claim Document.
5. Winner Notification and Prize Claim Conditions
The Sponsor will attempt to contact the potential winner by telephone within five (5) business days of the Draw Date. Once the selected entrant is contacted, the Sponsor will schedule a mutually convenient time for the Sponsor to administer the required Skill-Testing Question to that Participant, which must occur within eight (8) business days from the date of first contact following which, and provided the Participant correctly answers the Skill-Testing Question, the Sponsor will send that Participant (via regular mail delivery and email to the addresses confirmed by the Participant), the required Prize Claim Document that the Participant will be required to complete and return to the Redemption Centre, in a postage-paid envelope which the Redemption Centre will provide to him/her. The Prize Claim Document will contain, among other things, a declaration of eligibility and compliance with the Official Rules, a liability release and a publicity release and must be actually received (properly completed and signed by the selected Participant) by the Redemption Centre on or before a date which the Redemption Centre will specify to the Participant. When the Redemption Centre receives the completed Prize Claim Document, the Redemption Centre will begin the verification process described in these Official Rules. The Redemption Centre will inform the applicable Participant, if he/she is not a verified Prize winner, within approximately twenty (20) business days from the date the completed Prize Claim Document and any other required materials are actually received by the Redemption Center. If the selected Participant is verified as a Prize winner, the Redemption Center will award the Prize. Prizes will only be delivered to verified winners.
Return of any Prize or winner notification as undeliverable, inability to reach selected Participant or failure of selected Participant to respond to notification within five (5) business days of first attempt by Sponsor, failure to provide proof of eligibility (if requested), Prize Claim Document, or other required documentation in a timely manner twenty (20) business days, failure to correctly answer the Skill-Testing Question, or other non-compliance with these Official Contest Rules may result in disqualification, forfeiture of the Prize and, at the Sponsor’s sole discretion, selection of an alternate Participant, who will be eligible to receive the forfeited Prize but who will be subject to disqualification in the same manner described above. In the event a Participant is so disqualified, the Participant will have no claim against the Sponsor or any other person respecting the forfeited Prize or the Sweepstakes.
There are four (4) Prizes available to be won, each consisting of one (1) travel gift card valued at $10,000 each, redeemable through Away by TTI Travel. The odds of winning depend on the number of eligible entries received during the Entry Period.
Prize conditions: Prize must be accepted as awarded, except at sole discretion of the Sponsor which reserves the right in its sole discretion to substitute a prize of equal or greater monetary value in the event that the Prize cannot be fulfilled as described herein. Prizes are not-transferrable and cannot be applied to existing travel arrangements. Prize will be subject to terms and conditions printed on the card, or as otherwise specified by the Prize supplier. Winners will have the choice of any itinerary and flights (return economy airfare from major Canadian airports) to which Away by TTI Travel provides services subject to availability at the time of booking. Please request at least 90 days prior to departure for best availability. Cannot be extended or redeemed for cash. Changes not permitted once reservation is confirmed; cancellation insurance recommended (at an additional cost; not included in the Prize). Black-out periods apply (and may vary by hotel). Travel must be completed by March 30, 2017. All expenses not included in the Prize, included but not limited to travel, health and cancellation insurance, incidental and personal expenses, hotel service fees, souvenirs and gratuities will be the sole responsibility of the winner.
7. General Liability and Publicity Releases and Conditions of Participation
Sponsor is not responsible for illegible, misdirected, lost, damaged, late, incomplete or stolen Entries , Sweepstakes Draw Codes and/or Prize Claim Materials, which may be judged as void; for any damage to a Participant’s computer system or wireless device which is occasioned by accessing the Official Website, or by participating in the Sweepstakes, the accepting, redeeming or attempting to redeem a Prize; for interrupted, inaccessible, lost, incompatible or unavailable networks, servers, satellites, internet service providers, wireless carriers, websites (including the Official Website), or other connection; for availability or accessibility problems arising in connection with or over the course of the Sweepstakes or any matter related to the Sweepstakes; for miscommunications, scrambled, jumbled, failed, delayed or misdirected computer, telephone or cable transmissions, or hardware or software malfunctions, failures or difficulties; for any technical malfunctions, failures, or difficulties, printing errors or omissions clerical, typographical or other error(s) or omissions in any materials connected to the Sweepstakes including, without limitation, Sweepstakes Draw Codes, Prize Claim Document, registration form, communication whether written or oral, the offering or announcement of any Prize or in any Prize notification or email or letter; for any errors or omissions or failures of any kind, whether human, mechanical, clerical, electronic, interruption of power, or technical in nature; or, for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors. Sweepstakes materials (including Entries) and Prize Claim Documentation submitted are the sole property of the Sponsor and will not be returned.
By participating in the Sweepstakes and redeeming a Prize, each Prize winner hereby releases and agrees to hold the Sweepstakes Entities, the Prize supplier, the Redemption Center and their respective parent companies, subsidiaries, affiliated companies, divisions, advertising and promotional agencies, independent contractors, representatives and service agencies (the “Releasees”) and every director, officer, employee, agent, manager and member of any one or more of the Releasees harmless from and against any and all costs, injuries, losses or damages (including without limitation direct, indirect, incidental, consequential or punitive damages) of any kind, including, without limitation, death, bodily injury, and property or other damage or loss, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or in any activity related to the Sweepstakes, or participation in any Prize-related travel, activity or activities, or due in whole or part to the receipt, possession, use or misuse of any Prize or any part or parts of any Prize. Participants waive the right to assert as a cost of winning any Prize, any and all costs of verification and redemption or travel to redeem said Prize and any liability and publicity which might arise from redeeming or seeking to redeem said Prize. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to you.
It is each Participant’s responsibility to ensure that he/she has complied in full with all the conditions and requirements contained in these Official Rules. The Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering or interfering in any way with the process involved in entering the Sweepstakes or with the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in any unsportsmanlike or disruptive manner, or with the apparent intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to any, abuse, threaten or harass any other person. The Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
9. Force Majeure/Printing and Production Errors or Omissions
Sponsor reserves the right, without prior notice and at any time, to amend, modify or terminate the Sweepstakes, in whole or in part, in any way and for any reason. Without limiting the generality of the foregoing, the Sponsor reserves the right to amend, modify or terminate the Sweepstakes, in whole or in part, , if it determines, in its sole discretion, that the Sweepstakes is impaired or corrupted or that fraud or technical problems, failures or malfunctions (including, without limitation, computer viruses, glitches, or printing or production errors or omissions) have destroyed or severely undermined the proper play, integrity, and/or feasibility of the Sweepstakes. In the event the Sponsor is impeded or prevented from continuing with the Sweepstakes as planned or intended by any event beyond its control, including, but not limited to fire, flood, natural or manmade epidemic or health hazard or crisis, earthquake, explosion, labour dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), any federal, provincial, territorial or local government law, order, or regulation, public health crisis, the order of any court or jurisdiction, or by any other cause not reasonably within the Sponsor’s control, then the Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes.
The sole responsibility and liability of any printing, production or seeding errors or irregular Sweepstakes Draw Code is replacement with another randomly selected Sweepstakes Draw Code, as solely determined by the Sponsor. Replacement shall be the sole and exclusive remedy under such circumstance. If, due to printing or production errors or omissions or for any other reason whatever, the number of potential Prize winners coming forward seeking to claim Prizes exceeds the number of Prizes as set out in these Official Rules as being available in the Prize category in question, in the sole discretion of Sponsor, the winner may be selected in a random drawing from among all persons making purportedly valid claims for such Prize(s), inclusive in such drawing shall be each Participant’s sole and exclusive remedy under such circumstances. In no event will more than the number of Prizes stated herein be awarded.
By participating in the Sweepstakes and by submitting Prize Claim Materials, except where legally prohibited, each verified winner hereby agrees and grants the Sponsor the right, but not the obligation, to use his/her name, voice, and likeness, along with his/her address (city/town/village and Province/Territory) and any statements made by or attributed to such Winner in any and all media (including the internet), now known or hereafter devised, in perpetuity and throughout the universe, for advertising and promotional purposes in connection with the Sweepstakes without further notice, review, approval or compensation and releases the Sponsor and all directors, officers, employees, agents, advertising and promotional agencies, representatives, service agencies and independent contractors of the Sponsor from any and all liability with respect thereto.
All personal and other information requested by and supplied to the Sponsor for the purpose of the Sweepstakes must be truthful, complete, accurate, and in no way misleading. The Sponsor reserves the right, in its sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate, or misleading personal details and/or information.
Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that a provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Official Rules solely for ease of reference, and shall not be deemed or considered to affect in any manner the meaning or intent of these Official Rules or any provision thereof.
